TERMS OF SERVICE

1. COMPANY OVERVIEW

Earning Planer IT Services ("we", "our", "us") is a Jaipur-based, founder-led IT firm providing MERN stack development, mobile applications, Telegram bots & mini apps, API integrations, UI/UX design, digital marketing, and browser extension development. We are registered under Udyam (MSME): UDYAM-RJ-17-0423482. We do not engage in real-money gaming, gambling, or betting.

2. SCOPE OF SERVICES

Services include: • Custom web application development (MERN stack) • Mobile app development (Android, iOS, cross-platform) • Telegram bot and mini-app development • API design, integration, and automation • UI/UX design and graphic assets • Digital marketing and SEO • Website hosting and maintenance • Browser extension development and distribution • Educational content (YouTube tutorials)

3. CLIENT RESPONSIBILITIES

By engaging our services you agree that: • You are solely responsible for how the delivered product is used • You must ensure compliance with all applicable laws • We do not charge commissions on your revenue — all fees are fixed and quoted upfront • If your platform involves financial transactions, you are solely responsible for KYC/AML compliance

4. INTELLECTUAL PROPERTY

Upon full payment you receive ownership of final deliverables created for your project. We retain ownership of pre-existing code, libraries, and tools ("Proprietary Technology"). We grant you a perpetual, royalty-free license to use Proprietary Technology as part of your delivered product. You may not resell or sublicense it independently.

5. PAYMENTS & HOSTING

All fees are quoted and agreed before work begins. Hosting/maintenance fees (₹200–₹500/mo) cover server costs, backups, security updates, and support. First month is often free. Payments are non-refundable once work has commenced.

6. EXTENSION STORE TERMS

• License tokens are non-transferable and valid for the purchased duration only • Extensions auto-disable upon plan expiration — server validates every launch • Sharing, reselling, or attempting to crack tokens is strictly prohibited • We reserve the right to revoke access for abuse without refund • No refunds once a token has been issued and delivered

7. LIMITATION OF LIABILITY

To the fullest extent permitted by law (IT Act 2000, Section 79), we are not liable for: • Illegal or unauthorized activities by clients or their end-users • Financial loss, penalties, or reputational damage from client operations • Service interruptions caused by factors beyond our control Total liability shall not exceed the fees paid for the specific project.

8. TERMINATION

We may refuse or terminate services if a client engages in illegal activities, fails to pay, or violates these Terms. Upon termination the client must pay for all completed work. We will provide the current version of deliverables upon full settlement.

9. GOVERNING LAW

These Terms are governed by the laws of India. Disputes shall first be resolved through good-faith negotiation. Unresolved disputes are subject to the exclusive jurisdiction of courts in Jaipur, Rajasthan, India.
